All services provided by Relationwise may be used for lawful purposes only. Transmission or storage of any information, data or material in violation of any Danish law is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Relationwise from any claims resulting from the use of the service which damages the subscriber or any other parties.

Accounts are in default if payment is not received within 30 days after date of invoice. Accounts unpaid 30 days after date of invoice may have their service interrupted. Such interruption does not relieve the subscriber from the obligation to pay charge. Only a written request to terminate your service relieves you of your obligation to pay the account charge.

If the payment is not received, all files, information and mail under the account will be deleted. If the subscriber wishes to use the service again, the subscriber must re-apply as a new

subscriber.

The subscriber agrees that the company has the right to delete all data, files or other infor-

mation that is stored in the subscriber's account if the subscriber's account with the company

is terminated, for any reason, by either Relationwise or the subscriber.

Relationwise exercises no control whatsoever over the content of the information passing

through Relationwise. All leads (email addresses) generated by subscriber are held strictly

confidential. The leads are never released to any other parties for any purpose. The lead

information is only used on Relationwise' servers to deliver the follow up messages designa-

ted by the subscriber.

Customers are prohibited from transmitting on or through any of Relationwise' services, any

material that is, in Relationwise' sole discretion, unlawful, obscene, threatening, abusive,

libelous, or hateful, or that encourages conduct which would constitute a criminal offense,

give rise to civil liability, or otherwise violate any local, state, national or international law.

Relationwise makes no warranties of any kind, whether expressed or implied, for the service

it is providing. Relationwise also disclaims any warranty of merchantability or fitness for a

particular purpose. Relationwise will not be responsible for any damage suffered. This inclu-

des loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions

caused by Relationwise' negligence or the subscriber's errors or omissions. Use of any in-

formation obtained via Relationwise is at your own risk. Relationwise specifically denies any

responsibility for the accuracy or quality of information obtained through its services.

LIMITED LIABILITY. ANY LIABILITY OF THE COMPANY, INCLUDING WITHOUT LIMITA-

4.TION ANY LIABILITY FOR DAMAGES CAUSED OR ALLEGEDLY CAUSED BY ANY FAI-

LURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT,

DELAY IN OPERATION OR TRANSMISSION, COMMUNICATIONS LINE FAILURE, THEFT

OR DESTRUCTION OF OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE

OF RECORDS, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOR,

NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION, SHALL BE STRICTLY LI-

MITED TO THE AMOUNT PAID BY OR ON BEHALF OF THE SUBSCRIBER TO THE

COMPANY FOR THE CURRENT MONTH.

Should any provision of this terms and conditions be held to be illegal, invalid, or unenfor-

ceable by a court law, the legality, validity and enforceability of the remaining provisions of

this terms and conditions shall remain unaffected thereby unless otherwise stated.

This terms and conditions shall be governed by the laws of Denmark.

These Terms and Conditions supersede all previous representations, understandings or

agreements and shall prevail notwithstanding any variance with terms and conditions of any

order submitted. Use of Relationwise service constitutes acceptance of these Terms and

Conditions.

Acceptable Use Policy

I. We have a zero tolerance policy for SPAM.

hibited. If you paid money or in any way purchased a group of pre-existing leads these may

III. We may terminate user accounts at any time, without notice for conduct that violates

these guidelines. The following is a non-exclusive list of content and behaviours that are

unacceptable.

a. Content that contains links to pornography or adult content.

b. Content that promotes links to warez, cracks, hacks, or other piracy related information,

whether for educational purposes or not.

c. Content or surveys and emails that are promoted through the sending of unsolicited email

(spamming) or mail fraud schemes, or surveys and emails that promote or condone the

sending of unsolicited email to individuals not affiliated with the sender. Users are subject to

prosecution to the fullest extent of the law.

d. Content that commits acts of copyright, trademark, patent, trade secret or other intellectual

property infringement.

e. Content that is racist, or otherwise extremely offensive to others, including content which

aggravates, harasses, threatens, defames, or abuses others.

IV. We are not responsible for any deletion, alteration, or loss of surveys and emails or re-

sults due to network or system outages, file corruption, accidental deletion, incompatibilities

or any other reasons. We makes no guarantees as to server reliability, speed, or consis-

tency, and cannot be held liable for such.

a. Users are responsible for regularly monitoring and creating backups of their own files, and

agree to use our resources and infrastructure at their own risk. This service is provided on an

"as is" basis without warranties of any kind, either expressed or implied. Neither we nor our

partners makes any warranty with respect to any content, information, services, or products

provided through or in conjunction with this service.

b. We make no guarantee of the accuracy, correctness, or completeness of any information

on these web pages, surveys and emails, databases, or results and are not responsible for

any errors or omissions arising from the use of such information; any failures, delays, or in-

terruptions in the delivery of any content or services contained on our servers; or losses or

damages arising from the use of the content or services provided by us.

c. You agree to indemnify us against any and all claims and expenses, including attorneys'

fees, arising from the use of this service. This expressly includes your responsibility for any

and all liability arising from the violation or infringement of proprietary rights or copyrights and

any libelous or unlawful material contained within your survey and email.

V. Other rules and guidelines:

a. Free User accounts may be deleted after 60 days if there is no activity on the account, in

order to free up resources.

VI. Refund Policy: The company does not provide refunds or returns.

VII. The Company reserves the right to amend or change these guidelines at any time with-

out notice.

VIII. These conditions and our services are governed by Danish law. In case of any dispute

the Court in Copenhagen , Denmark is venue.

Privacy Policy

We collect and analyze aggregate information of visitors, including the domain name, visited

pages, referring URLs, and other publicly available information. We use this information to

help improve our web site and services, and to customize the content of our pages for each

individual customer.

We do not sell or make commercially available specific information about users or their col-

lected data , except in cooperation with law enforcement bodies in regards to content viola-

tions or violations of applicable laws. We maintain a database of member information which

is used only for internal purposes such as technical support, notifying members of changes

or enhancements to the service and new services and products that may be of interest to

them.

What about email addresses I upload for distribution?

We do not make any information that you upload available to anyone else. This also applies

to any graphics or multi-media clips that you upload for hosting along with your survey and

email.

Will the data I collect be shared/sold/used by anyone else?

No. We are strongly committed to protecting the data and will not make available any portion

of your data to anyone else.

What happens to my data after I cancel my account?

We keep your survey and email data as long as your account is active with us. If you cancel

your account (or payment for your account is not received) we delete all of your surveys and

emails and associated data. This is not reversible.

Server facilities

Relationwise Survey and Newsletter Solution is located on Relationwise A/S’s server facili- ties at DIR (a part of TDC Hosting). All relevant measures have been taken to ensure that the servers are secure against unauthorised intrusion.

Upgrades Continual upgrades will be made to the solution which will be automatically made available

without extra charge to the customer.

Usage rights A storage space of 25MB is allowed for image storage for each client. The solution’s e-mail

sending velocity is 18.000 sends an hour. The customer has usage rights to the system, but the customer is not permitted to sell, rent, or otherwise afford the solution to a third party.
